I see that Newsquest has warned members of the National Union of Journalists that they may be in breach of their employment contracts if they take part in tomorrow's planned one-day strike.NUJ members voted for industrial action after the publisher announced that it was transferring sub-editing roles from its Darlington, York and Bradford centres to a production hub in Newport, South WalesAccording to Newsquest, the ballots were invalid because they stated that staff would be made compulsorily redundant. The company denies this in a letter to editorial staff at all three centres where strikes are planned - Darlington, York and Bradford.It describes the "restructure" as being covered by the Transfer of Undertakings (Protection of Employment) regulations (TUPE) because "employees have a choice as to whether they transfer to Newport, where there are enough roles for those wishing to continue their employment with the company." The letter continues:"Should the employees choose not to transfer they may opt for a payment with a settlement agreement. No employee will be made compulsorily redundant by Newsquest (Yorkshire and North East) Ltd as stated in the ballot paper."In other words, up sticks from counties Durham or Yorkshire and settle in Wales or - if that word "may" is to be taken at face value - a redundancy package will be optional and voluntary.But is that really going to be the case?
